That looks like quite a clear case of "Well, don't do that, then!" to 
me.  Nobody forced the user to put the box into such a silly position. 
So if they requested it there, we have to assume that's exactly what 
they wanted.

I don't see what the key has to do with this.  Yes, the colorbox should 
have layering control.

Objection.  Drawing it always on top of everything else would be worse 
than the current state of affairs.  People might have reasons to obscure 
parts of it --- i.e. they might hold their actual data more important 
than the legibility of the colourbar.
