Settlers 3 (Gold Edition, but i'm pretty sure also the normal version) works pefectly in windowed mode on Win 7 32/64 bit. On Windows 8 the game starts, no matter which options are selected, in fullscreen mode with a blank upper "area" on the top of the window (see attached screenshot).
Settlers 3 creates, right after the ingame window is created, a hidden Window called "CDAudio". Maybe this window isn't handled properly in Win 8 or something concerning the Window Aero stuff changed from Win 7 to Win 8.

I just moved with my mouse over the taskbar icon, and the resolution and "windowed" mode seems fine. I don't know if this information is usefull, but at least you can see the upper cut area in a better way.

You will have to have some little patience because I'm developing on a Win7 pc and I currently have no Win8 machine to test.
The log isn't showing anything weird (apart from running the game from the root of a virtual device z:), but I don't see how that could possibly make the difference.
