I tried, to pach the latest (2.6.8.1) via-ircc module, but it looks like 
there is no clean patch possible. After:

Anyway. I even sort of sucsesfully compiled this new module, but after

modprobe via-ircc

dmesg shows:

divert: not allocating divert_blk for non-ethernet device irda0
IrDA: Registered device irda0 (via-ircc)
change_dongle_type = 0xe00,0
Warning: dongle_id 0 unsported !
via_ircc_net_open

I always got the first two lines in 2.6.8.1 kenel, but the rest is new. 
I even tried with dongle_id=0x09, but no luck It looks that irda stack 
is running, but my phone could't be discovered.
I know that we first need a clean patch, but maybe those additional 
information will help you somehow. I'll be glad to help you from the 
users POV, because I am not a programmer.
