I didn't decompile the binary.  However, unless this is a very old TPM, 
I would hesitate to blame it.  This doesn't sound like a corner case 
that would not be tested.

The TCG compliance test used PCR 16 (the debug PCR) and owner authorization.

When he showed me the SW TPM trace, it did not quite agree with his text.
