I think (and correct me if I'm wrong) it's simply a best-effort approach. No one can expect a volunteer moderator to account for every bit in a capture, but some general assumptions can be made at first glance regarding the risk associated with publishing a capture. This *courtesy* coupled with a solid disclaimer of liability creates a comfortable balance of open atmosphere and privacy.
