You don't say which parser you're using or how you're trying to access elements of the DOM. When I was investigating the use of XPath with HttpUnit (see http://idiacomputing.com/moin/HtmlTestingUsingXpath), I found that the NekoHTML parser did not give me a tree that could be used, but the JTidy parser did. Of course, JTidy is also pickier about the document being well-formed, so if your HTML is sloppy, this may not help you. Generating a DOM tree from HTML that doesn't follow the rules is, by definition, problematic.
