Testing with 1.2.4:

Focusing on positions, I don't understand why this query returns  "6 7  
8 9 10 11"

let $doc := <root>
  <el att="1">A</el>
  <el att="1">C</el>
  <el att="2">B</el>
  <el att="2">D</el>
  <el att="1">E</el>
  <el att="2">F</el>
</root>
return $doc/*[true()]/position()

Saxon returns 1 2 3 4 5 6

Further:
return $doc/*[position() = 1 or position() = last()]

eXist	 :  <el att="1">A</el>
Saxon	 :  <el att="1">A</el>  <el att="2">F</el>


The plot thickens.
