I have been constantly reminding the "Apple guy" whose message I forwarded to this list a while ago. He never came back with a clarification. I think he went way out of his way of writing that message in the first place. Because of the fact that Apple in general isn't more specific (apart from some very top-level emails where people claim they originate from Steve Jobs himself) I come to the conclusion that Apple is exercising FUD. I'm not with Apple; I cannot tell you their intentions. If you fall for the FUD, then don't use XMLVM.
