Reproduction:
With bug:
1. download zip from here: https://github.com/dhbw-horb/latexVorlage
2. unzip
3. open \latexVorlage-master\content\01kapitel.tex
4. Compile 01kapitel.tex -> root doesn't get detected
Without bug:
1. unzip again (is importaned)
2. open \latexVorlage-master\dokumentation.tex
3. open \latexVorlage-master\content\01kapitel.tex
4. Mark dokumentation.tex as root manually
5. Compile 01kapitel.tex -> works
I don't know what i did but in my document i don't have this problem anymore and in my document it's not reproduceable.
Sorry that i couldn't provide a minimalistic example.
As explained in the StackExchange answer, TeXstudio currently only supports the spelling
% !TeX root =
, whereas your example contains%!TEX root =
.We've already changed the code to be more permissive. So your spelling will work as well in the next release.

Thank you for your reply. From your answer on stackoverflow i didn't get that the spacing between % and ! and the lower case "e" is important.
