When booting, refit lists my Win7 partition as Legacy OS with a grey icon. I am able to boot into windows and everything works fine on the windows side.
On the mac side... I do not see the drive listed when booted into Mac os x (10.6 latest) Dis ultility shows the drive by the disk name and greyed out like it didn't initialize. Bootcamp doesn't see the partition.
Steps to create the dual boot:
Installed refit
created partition through bootcamp
Booted Win 7 installed via USB
Formatted partition to NTSF
installed Win7 64-bit
Like I said, everything is working fine on the windows side, I'm actually able to see the mac drive and all the mac drive contents from the windows side as well.
However, not able to even see the drive from the mac side.
Any help would be greatly appreciated.

Maybe the partition was created in Windows instead of Mac OS X. Your GPT and MBR maybe out of sync. The MBR might have a partition that is not in the GPT. You might have to fix it manually (Don't use rEFIt's sync tool to fix this). Or maybe the partition does exist but the type might be wrong.
Use the script at http://members.shaw.ca/joevt/dumpvols.sh.zip to list your partition info. Then we can figure out how to clear up the discrepancy.
