Your copy would have the exception because you got revision X.
Revision X+1 would not, and therefore you wouldn't be able to distribute FTDI2XX any longer as part of >= X+1.
People who want to keep revision X 5 years later can do so, but would no longer get the latest-and-greatest code.

Well, you would have a hard time deleting the code from my computer
and I would still be able to distribute it, so not it can not be totally
removed.
