My inclination would be to treat ticks the same as grid lines for graphs, hence 
in back.  My feeling is that the data should not be obscured.  I occasionally 
run across this problem in PS plots and can usually depend on using the tick 
mark on the opposite side (i.e. the top or right) for measurement.

Of course, if the tick marks are on the outside of the graph, then this isn't a 
problem.
