I suggest you put a privacy statement hyperlink control right next to the checkbox, but don't tell the user that he's making a dumb choice when he unchecks the option. Another thing to be careful about is to ensure that no data is sent before the user has had the chance to turn off that option. Most privacy-conscious users will have a firewall, and if you try to sneak info out of them before they can override the option, they will know, they won't like it, and you won't get the info anyway.
