I compiled and ran (using bin/startup.sh) the current svn trunk (r9828) 
and it has the same problem, using the validation-jing-report() function 
to validate based on a Schematron schema from XQuery.  The code looks 
like it passes the unit tests.  I get the same error whether I use the 
minimal example Schematron/XML document that I attached in a previous 
email, or I store the schema and document from the unit test 
(samples/validation/tournament/1.5/tournament-schema.sch and 
Tournament-valid.xml) into the database, then run 
validation:jing-report() on those.  It doesn't matter whether both 
documents are in the same collection or different collections, or are 
simply dumped into the XQuery source as the contents of a variable.  It 
also doesn't matter whether I use the XQuery sandbox or send the query 
via HTTP POST.
