This problem is caused by fo/table.xsl and fo/footnote.xsl threating all <footnote> elements inside <table> or <informaltable> as table footnotes. While only elements in actual table contents (<tgroup>) should be there. I'm attaching simple patch for 4.x that checks elements just in <tgroup>, I'm not sure if it is good enough. Note that DocBook5 XSL is unfortunately broken too.
