Yes, it is now uncheckable with Gtk-2.6 I'm not sure if it will stay here too long. In fact this "Always on top" stuff should be managed by the window manager not the app, and it will not work in all window managers, so may be it could be removed in a near future. As example, with gnome/metacity it's much better to set the "On top" menu item on the window frame - it can be disabled - instead of the built-in "On top" functionality. If I finally decide not to remove it, I will implement a roundabout to be able to uncheck it, meanwhile 2.6 don't reaches the distros.
