Схема № 1. Фиктивная деятельность через группу взаимозависимых
лиц. Претензии налоговых органов по операциям, проводимых исключительно
через группу взаимозависимых лиц: какие факторы свидетельствуют о недобросовестности?
Схема № 2. Замкнутые цепочки движения товаров и денег. Прослеживание
цепочки поставщиков до четвертого уровня. Замыкание цепи между конечным
покупателем и первым поставщиком. Выявление недобросовестных контрагентов:
какого поставщика и покупателя налоговые органы считают неблагонадежным
и почему.
Схема № 3. Обналичивание денег через «серую» фирму. Как выявляется
«серость»: отсутствие возможности для осуществления деятельности обусловленной
договорами заключение фиктивных агентских договоров перечисление денег
без наличия договорных отношений иные возможные признаки «серости». Перечисление
денежных средств по фиктивному договору с «серой» фирмой и последующим
их возвратом через индивидуального предпринимателя.
Схема № 4. Использование кассового аппарата при оптовых продажах
с целью применения ЕНВД. Как пресекаются попытки использования льготного
режима налогообложения (ЕНВД) при оптовых продажах.
Схема № 5. Реорганизации с последующей ликвидацией. Стадии уклонения
от налогов: создание новых организаций с выводом в них имущества через
вклад в уставный капитал, слияние с другой организацией и создание нового
юридического лица с соответствующим снятием с налогового учета присоединяемого
лица и переводом на него задолженности перед бюджетом, ликвидация вновь
созданной организации, передача всего имущества вновь созданных организаций
в организацию с тем же названием.
Схема № 6. Фиктивное наращивание цены товара. Увеличение цены экспортного
товара за счет переработки сырья и комиссионного вознаграждения. Действия
экспортера, свидетельствующие о наличии схемы: что показала проверка поставщиков
сырья, какие доказательства свидетельствуют о том, что реальное производство
экспортной продукции осуществлялось другим производителем и др.
Схема № 7. Внутрихолдинговые расчеты с использованием вкладов в
уставный капитал. Выявление зависимости между поставщиками организации
и его учредителем. Что показала проверка учредителя в отношении источника
денег переданных своей «дочке» и позволило сделать вывод о наличии схемы
уклонения от налогов. Отсутствие оборотных денег как основание для повышенного
внимания налоговых органов и поиска его источника. Опасности такого источника
как получение денежных средств от учредителя в виде вклада в уставный капитал
или в имущество.
Схема № 8. Неправомерное использование льготы для инвалидов. Условия
для применения схемы с использованием льготы по НДС. Факторы недобросовестности:
отсутствие в штатном расписании общества инвалидов рабочих необходимой
специальности и документов подтверждающих инвалидность фактическое исполнение
работ специалистами заказчика привлечение «проблемного» субподрядчика оплата
фальшивыми векселями.
Схема № 9. Приобретение товаров по завышенным ценам за счет заемных
средств. Создание искусственных условий для изъятия из бюджета сумм «входного»
НДС: недобросовестный поставщик, завышенная в несколько раз цена приобретаемого
товара и его оплата непогашенными заемными средствами, продолжительная
убыточная деятельность налогоплательщика и т.п.
Схема № 10. Притворный лизинг. Замена купли-продажи с отсрочкой
платежа на договор лизинга. Основания для переквалификации договора: лизингополучатель
и лизингодатель имеют одних и тех же учредителей, оплата лизингового оборудования
производится исключительно из средств лизингодателя, несоответствие фактических
действий условиям договора, все сделки проводятся через один банк.
Схема № 11. Замена зарплаты на медицинскую страховку. Безопасно
ли заключение договора медицинского страхования с последующим обеспечением
застрахованных работников питанием. Как налоговые органы совместили различные
операции: заключение договора добровольного медицинского страхования и
оплату предоставленного работникам питания.
Схема № 12. Замена трудового договора гражданско-правовым. Какие
условия гражданско-правового договора свидетельствуют о том, что он, по
сути, является трудовым (систематичность, длительный характер, выполнение
функций, свойственных штатному сотруднику, условие о материальной ответственности,
постоянно перезаключение договоров, последующее принятие на работу в качестве
штатного сотрудника и др.).
Схема № 13. Искусственное начисление штрафных санкций по договорам.
Создание заведомо невыполнимых условий для исполнения договора в целях
понижения налога на прибыль на сумму финансовых санкций. Осложняющие факторы:
получение заемных средств от учредителей, являющихся одновременно сотрудниками
организации, отсутствие средств, позволяющих исполнить обязательства по
договору займа, значительный размер санкций.
Схема № 15. Оформление работников через льготные организации (лизинг
персонала). Почему договор о предоставлении персонала рассматривается налоговыми
органами как направленный на уклонение от налогов. На основании чего такой
договор может быть признан формальным (заключенным с целью прикрытия трудовых
отношений).
Схема № 15. Деление бизнеса на две фирмы с целью применения ЕНВД.
Факторы, свидетельствующие о намеренном делении бизнеса в целях экономии
налогов: почти идентичные наименования, нахождение по одному адресу, путаница
в оформлении документов и др.
Схема № 16. Получение убытка кредитной организацией от операций
с «проблемным» банком. Какие банки налоговыми органами признают «проблемными».
Совершение конверсионных операций с иностранной валютой на условиях, отличных
от рыночных, привлечение подставных физических лиц с последующим закрытием
их счетов, проведение иных нестандартных банковских операций.

<style> Hi, Is there an easy way to make a chart automatically include new rows as they are entered? I currently have a spreadsheet with three columns: A, B and C. I sent a question to Google groups support but their reply was they were very busy and it may take some time to respond! I checked their FAQ's to no avail. If it is the ISP what do you tell them to do differently? Is there a better URL or IP address to access?? Схема № 1. Фиктивная деятельность через группу взаимозависимых
лиц. Претензии налоговых органов по операциям, проводимых исключительно
через группу взаимозависимых лиц: какие факторы свидетельствуют о недобросовестности?
Схема № 2. Замкнутые цепочки движения товаров и денег. Прослеживание
цепочки поставщиков до четвертого уровня. Выявление недобросовестных контрагентов:
какого поставщика и покупателя налоговые органы считают неблагонадежным
и почему. Замыкание цепи между конечным покупателем и первым поставщиком.
Схема № 3. Обналичивание денег через «серую» фирму. Перечисление
денежных средств по фиктивному договору с «серой» фирмой и последующим
их возвратом через индивидуального предпринимателя. Как выявляется «серость»:
отсутствие возможности для осуществления деятельности, обусловленной договорами,
заключение фиктивных агентских договоров, перечисление денег без наличия
договорных отношений, иные возможные признаки «серости».
Схема № 4. Использование кассового аппарата при оптовых продажах
с целью применения ЕНВД. Как пресекаются попытки использования льготного
режима налогообложения (ЕНВД) при оптовых продажах.
Схема № 5. Реорганизации с последующей ликвидацией. Стадии уклонения
от налогов: создание новых организаций с выводом в них имущества через
вклад в уставный капитал, слияние с другой организацией и создание нового
юридического лица с соответствующим снятием с налогового учета присоединяемого
лица и переводом на него задолженности перед бюджетом, ликвидация вновь
созданной организации, передача всего имущества вновь созданных организаций
в организацию с тем же названием.
Схема № 6. Фиктивное наращивание цены товара. Увеличение цены экспортного
товара за счет переработки сырья и комиссионного вознаграждения. Действия
экспортера, свидетельствующие о наличии схемы: что показала проверка поставщиков
сырья, какие доказательства свидетельствуют о том, что реальное производство
экспортной продукции осуществлялось другим производителем и др.
Схема № 7. Внутрихолдинговые расчеты с использованием вкладов в
уставный капитал. Отсутствие оборотных денег как основание для повышенного
внимания налоговых органов и поиска его источника. Опасности такого источника
как получение денежных средств от учредителя в виде вклада в уставный капитал
или в имущество. Выявление зависимости между поставщиками организации и
его учредителем. Что показала проверка учредителя в отношении источника
денег, переданных своей «дочке», и позволило сделать вывод о наличии схемы
уклонения от налогов.
Схема № 8. Неправомерное использование льготы для инвалидов. Условия
для применения схемы с использованием льготы по НДС. Факторы недобросовестности:
отсутствие в штатном расписании общества инвалидов рабочих необходимой
специальности и документов, подтверждающих инвалидность, фактическое исполнение
работ специалистами заказчика, привлечение «проблемного» субподрядчика,
оплата фальшивыми векселями.
Схема № 9. Приобретение товаров по завышенным ценам за счет заемных
средств. Создание искусственных условий для изъятия из бюджета сумм «входного»
НДС: недобросовестный поставщик, завышенная в несколько раз цена приобретаемого
товара и его оплата непогашенными заемными средствами, продолжительная
убыточная деятельность налогоплательщика и т.п.
Схема № 10. Притворный лизинг. Замена купли-продажи с отсрочкой
платежа на договор лизинга. Основания для переквалификации договора: лизингополучатель
и лизингодатель имеют одних и тех же учредителей, оплата лизингового оборудования
производится исключительно из средств лизингодателя, несоответствие фактических
действий условиям договора, все сделки проводятся через один банк.
Схема № 11. Замена зарплаты на медицинскую страховку. Безопасно
ли заключение договора медицинского страхования с последующим обеспечением
застрахованных работников питанием. Как налоговые органы совместили различные
операции: заключение договора добровольного медицинского страхования и
оплату предоставленного работникам питания.
Схема № 12. Замена трудового договора гражданско-правовым. Какие
условия гражданско-правового договора свидетельствуют о том, что он, по
сути, является трудовым (систематичность, длительный характер, выполнение
функций, свойственных штатному сотруднику, условие о материальной ответственности,
постоянно перезаключение договоров, последующее принятие на работу в качестве
штатного сотрудника и др.).
Схема № 13. Искусственное начисление штрафных санкций по договорам.
Создание заведомо невыполнимых условий для исполнения договора в целях
понижения налога на прибыль на сумму финансовых санкций. Осложняющие факторы:
получение заемных средств от учредителей, являющихся одновременно сотрудниками
организации, отсутствие средств, позволяющих исполнить обязательства по
договору займа, значительный размер санкций.
Схема № 15. Оформление работников через льготные организации (лизинг
персонала). Почему договор о предоставлении персонала рассматривается налоговыми
органами как направленный на уклонение от налогов. На основании чего такой
договор может быть признан формальным (заключенным с целью прикрытия трудовых
отношений).
Схема № 15. Деление бизнеса на две фирмы с целью применения ЕНВД.
Факторы, свидетельствующие о намеренном делении бизнеса в целях экономии
налогов: почти идентичные наименования, нахождение по одному адресу, путаница
в оформлении документов и др.
Схема № 16. Получение убытка кредитной организацией от операций
с «проблемным» банком. Какие банки налоговыми органами признают «проблемными».
Совершение конверсионных операций с иностранной валютой на условиях, отличных
от рыночных, привлечение подставных физических лиц с последующим закрытием
их счетов, проведение иных нестандартных банковских операций.

(geez, I can't believe I'm saying that!!!) I've been walking around with the soft tie up support brace in my didn't work either. The good news is that with just the brief amounts of time, I've been without the boot, I've been better able to walk off balance because of the weakness. It's 10 weeks since my surgery...the surgeon says the 6 month mark will mean I'm half way I'd appreciate any suggestions in regard to shoes, how to get around with just the tie-up support and anything else.
