Hi Felix, I'm not against the change - what I'm trying to point is that some due diligence is needed before accepting the change on release - specially I think we need to consult FSF explaining all the situation.
If you want you're invited to next release meeting* and we can discuss there how is the situation and we can review redaction of consultation to FSF.
ADempiere is GPLv2 for sure.
We have voting and discussion which version to choose and community forked Compiere after it change it's license to GPLv2.
I think that the fact that Compiere didn't changed the license in the SVN is technical. License in the source code is GPL v2.

I think this issue should get some more attention.
ADempiere is GPLv2, isn't it?
The right file to add would then be http://www.gnu.org/licenses/gpl-2.0.txt.
This file should be placed in the root and named COPYING.

there are some more files to remove
The license was duplicated at several places before. I have a look at attached
a patch removing it at three more places.
Can somebody advise us (or did somebody already consult) if this change is valid from the legal point of view?

Everywhere on the Internet ADempiere is lited as an GPL project, therefore this does just clarify the license and not change it.
According to my research ADempiere 3.1.1 was the first ADempiere version to be 100% GPL compatible. See for example http://www.metas.de/fileadmin/metas/news/metas_ADempiere_CEBIT.pdf slide 3.
