GPX Viewer: legal notice

Please read this notice before downloading or using GPX Viewer. By downloading, installing or using the software you accept it. If you do not accept it, do not use the software.

1. Free software, provided as is

GPX Viewer is free, open source software released under the MIT License (the LICENSE file included with every download). It is a personal, non-commercial hobby project. It is not sold, no support is promised, and no contract or service is created by downloading it.

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. You use it entirely at your own risk.

2. Not for navigation, safety or emergencies

GPX Viewer is a tool for looking at and editing recorded or planned tracks. It is not a navigation device and must not be relied on for navigation, route finding in the field, safety decisions or emergencies. Maps, routes, elevations, gradients, surfaces, distances, times and every other value it shows can be incomplete, outdated or wrong. Routes it plans or edits may cross private land, closed roads, dangerous terrain or places where access is not allowed. Always check conditions on the ground, follow local rules and signs, and use your own judgement.

3. Health and fitness data is not medical advice

Heart rate, cadence, speed, temperature and other values come from your own files and devices and are shown for personal interest only. GPX Viewer is not a medical device and gives no medical, health or training advice. Ask a qualified professional before making decisions about your health or training.

4. Your files and your privacy

GPX Viewer has no account, no analytics, no advertising and no tracking. Your files are opened, analysed and saved on your own computer. Some features send data to online services, but only when you use them:

• map tiles for the area you are looking at;
• place searches and addresses;
• the coordinates of a route when you ask for official terrain, route analysis or route planning.

Each service receives that data under its own privacy terms. The details are in PRIVACY.md. You are responsible for the files you open, edit and share, including any personal or location data in them, and for having the right to use them.

5. None of the maps or map data belong to the author

The author of GPX Viewer does not own, create, host, sell, license or control any of the maps, satellite or aerial images, elevation data, place names, addresses, routes or other geographic data shown in the app. All of it belongs to the organisations and communities listed below, and to their own suppliers.

• Shown, not distributed: GPX Viewer does not include or distribute map images or map data, except the small OpenStreetMap region file described below. When you look at a map, your computer requests it directly from the provider's own server, as a web browser would. The provider decides what it sends and under which terms.
• Not covered by the MIT License: the MIT License of GPX Viewer covers only the source code and documentation written for this project. It gives no rights to any map, image or data. Your use of each map remains subject to its owner's license and terms of use.
• Attribution: the app shows each provider's credit on the map and in its Credits window, as the providers require. Do not remove or hide these credits when sharing screenshots or images made with the app.
• No permission given: nothing in this project grants you permission to copy, download in bulk, resell or republish any map or data. If you want to reuse a map or its data outside normal viewing in the app, ask its owner or follow its license.
• No guarantee: the author does not check, correct or guarantee the content of any map or data. Errors in maps or data are the responsibility of their providers, and reliance on them is at your own risk (see section 2).
• Service changes: providers may change their terms, require keys, limit use or stop a service at any time. The app may then show a different map or none.
• Bundled region outlines: the bundled file Regions.json contains simplified region outlines from OpenStreetMap, © OpenStreetMap contributors, under the Open Database License (ODbL 1.0, opendatacommons.org/licenses/odbl/1-0/). It is not covered by the MIT License.

Your own keys and accounts

• Keyed services: some maps (Thunderforest and Esri) only work with your own API key from that provider. You create the key under your own account and accept that provider's terms. Any usage limits, charges or account consequences are yours, not the author's.
• Geoportail Luxembourg: sign-in happens on Geoportail's own page and is subject to its terms.

Acceptable use

• Normal viewing only: use the maps only for normal interactive viewing.
• No bulk downloading: do not use the app, or modify it, to bulk download, scrape, prefetch for offline use or cache tiles beyond what the providers allow.
• Respect usage limits: for example, the OpenStreetMap tile usage policy forbids bulk downloading.
• Non-commercial maps: some maps are free for non-commercial use only, including Belgian NGI CartoWeb.be maps and free Esri keys.

6. No affiliation, trademarks

GPX Viewer is an independent project. It is not affiliated with, endorsed by, sponsored by or connected to any company or organisation named in the app or its documents, including:

• Apple Inc.;
• Garmin Ltd.;
• Esri;
• Thunderforest;
• the OpenStreetMap Foundation;
• the Luxembourg Administration du cadastre et de la topographie;
• NGI Belgium;
• IGN France;
• Strava;
• Microsoft.

All product names, logos, brands and trademarks belong to their owners. They are used only to describe compatibility, file formats or data sources.

Apple, Apple Maps, Mac and macOS are trademarks of Apple Inc. Garmin is a trademark of Garmin Ltd. or its subsidiaries. Windows is a trademark of Microsoft Corporation.

GPX Viewer contains no Garmin software or Garmin data and does not open FIT files.

7. Downloads and installation

• Unsigned: the Mac apps are not signed with an Apple Developer ID or notarised by Apple, so macOS asks you to confirm before the first launch.
• Where to download: download GPX Viewer only from this SourceForge project, and compare the SHA1 or MD5 checksum shown next to each file.
• Modified copies: copies obtained elsewhere, or modified by others, are not the responsibility of the author.
• Back up first: keep backups of your files. Saving overwrites the file you chose, and you should keep a copy of any original you care about.

8. Limitation of liability

To the fullest extent permitted by applicable law, the author and contributors are not liable for any damages or losses arising from the use of, or inability to use, GPX Viewer, the maps and data it shows, or the services it connects to. This applies whether the claim is based on contract, tort (including negligence) or anything else, and even if the author was told such damage was possible. It includes:

• direct, indirect, incidental, special, consequential or punitive damages;
• personal injury, property damage or loss of life arising from reliance on routes, maps or values;
• loss of data, files, profits or opportunities;
• fees charged by third-party services.

Nothing in this notice limits or excludes any liability that cannot be limited or excluded under the law that applies to you. In particular, it does not affect liability for intent or gross negligence where the law does not allow that, or the mandatory rights of consumers. If any part of this notice is found invalid, the rest still applies.

9. Contributions, rights holders and contact

Contributions to the project are accepted under the MIT License.

If you believe something in this project infringes your rights, or a provider's terms are not followed correctly, please open a ticket in the project's Tickets section. Describe the issue there and the author will look at it and correct or remove the material where appropriate.

This notice may be updated with new releases. The version included with, or published next to, a release applies to that release.
