I don't see this behavior here.

How can you tell that Saxon is invoked instead of Xalan? Have you
checked the message area? It should say what processor is invoking.

If it still doesn't work, please submit a bug report using the menu
entry in XSLT => Help => Submit bug report. That will help me
investigate your problem more thoroughly.
