I'm new to this mailing list and discussion. Liviu and Iwan should know
me already since I have shared 13 new maps in the past few weeks.
In my opinion there is actually no real advantage in keeping names of
existing cars. Maybe I see this different because I'm not a fan of cars
or car brands.
Depending on how close the Trigger Rally car vehicle 3D models are to
existing real cars I would even consider altering those models to not
eventually end up in an unpleasant legal threat just because the game
gains some interest in the future possibly.
I can imagine TORCS is a completely different matter since it's not
realistic at all. And TORCS has the benefit of having the luxury of a
huge community supporting it. They can adapt everything very fast.
Therefore they can gamble with such a possible threat without any
For Trigger Rally there are just very few occasionally available people
with only partly sufficient skills for implementing any urgent changes.
We don't need to make any profit with Trigger Rally. This just doesn't
matter for the question if brand owners are allowed to decide where and
how their brand is used. (The money question just concerns the claimed
repair sums in any possible legal case.)
Owners of brand names consisting of terms freely usable in other
contexts can still insist on their authority to decide if or how obvious
references to their brands can be used.
In my opinion we gain nothing from keeping something in the game which
could potentially cause problems - even if it is not very likely Trigger
Rally gets sued right now. Nobody knows the future. Maybe for some
reason Trigger Rally will get very prominent later on.
We could even make a joke of altering the references:
Seat Cordoba -> Sweat Canberra
Ford Focus -> Fond Famous
Mitsubishi Evolution -> Mitcolishi Emotion
or any other names...
