If the license for the instant client allows this, it will work. However to my knowledge this will not enable you to dynamically load the DLLs as for mysql/psql.
If you compile tora without Oracle support the instant client DLLs will never be loaded, with Oracle support compiled in you will always need the DLLs.
Who is able to decide if we are allowed to redistribute the Oracle DLLs? The instant client license terms for Open Source software are:

However it's not possible to dynamically add this support during runtime as
it works for MySQL and PostgreSQL. The necessary QT SQL driver for Oracle is
not available in the Open Source edition of QT4 due to license reasons.
lets distribute it with instant client DLLs. It's allowed (imho) by its
license. I'm playing with it today and it looks like it's working.
