The most likely reason you are seeing this problem is that the BR element is not in the XHTML namespace. If it's an ordinary XML element, then it will be output as shown.

Release is indeed available on SourceForge, but I see that there are links on that have not been updated. You can find all releases here:

We picked up this in Saxon Home Edition (HE) and it is still an issue in Saxon HE Unfortunately, the source for Saxon HE is not yet available for download from Source Forge.

I have attached our solution to this issue.

Please review this issue, the attached sample solution and advise if this issue will be classified as a bug and the time frame for resolving it.
