One of the things that's never been clear for PBEM play is whether each player needs to have their own copy. It's fair use for me to photocopy the rules for 1856 so that there can be a copy at each end of the table when 6 of us are playing in my kitchen; it's less clear whether I can email the rules to 5 people in 4 countries when playing PBEM. With that said, there are a wide variety of player aids on BoardGameGeek, even for games with aggressive rights holders... so some copying of game ideas (but not word-for-word actual content) would seem to be OK. (You can copyright words and images but not ideas. However, IANAL.) I remember in the 90s playing PBEM Titan where the moderator simply required one player in each game to own a copy, but online violations of intellectual property rights were far less of a concern back then. - Aliza |
