I am trying to upgrade from 2.65 to 3.0 I followed the instructions but when I came to the step of opening upgrade.php in my browser, I got the following error:

I'm also unable to chmod this file, though "nobody" is the owner so I'm not sure why not (perhaps someone was using the site?)

All of the files in the ./index/ directory are automatically generated by the program. That is why the user is "nobody", but this also means that it should have plenty of permissions to update the file. So I'm not sure what happened there.
In any case, the simplest thing would be to just erase the file, and then when you are finished upgrading, go to the Manage Gedcoms area and edit the gedcom configuration again to create a new one.
