I heard back from the FSF and they suggest the following algorithm for deciding which code we salvage and which we must rewrite. I will send an open letter to Tenable to make sure we have a documented understanding about what we need to do so as not to infringe on their hard earned intellectual property.

Over the last few weeks many questions have been raised about which parts of the Nessus code are really protected by GPL and which will need to be rewritten. I have contacted the FSF to get a more authoritative answer (although technically this is NOT legal advice) and should hear back soon.
According to the person I spoke with at FSF headquarters here in Boston Nessus has shown up on their radar screen a few times. I'm really glad we have organizations like this to help us out. As I mentioned at Pumpcon, half of this project is technical. The other half is purely legal. Unfortunately Tenable has not been very forward with answers to these questions in a public forum.
