Day 2 of the face-to-face was just concluded. The item that was discussed that I thought was noteworthy had to do with electronic service. Legal XML seems to be under the belief that electronic service should be conducted during all filings. This is a good ideal but possibly naive. In the Court Filing Blue use cases they discuss a court maintaining a service list for all case parties. When a final confirmation of a filing is sent to an EFSP they envision the service list being sent along with it. Thus allowing the EFSP to serve parties electronically when applicable and to tell filers which parties they will be responsible for serving in traditional ways. This sounds fine, however most courts currently do not maintain the services lists. This would require courts to implement some form of service list into their CMS. Because of this I do not feel that it will initially be embraced by courts. Some courts also designate the responsibility of maintaining a service list to one of the case parties.
