So, the boot-up image with the penguin head
superimposed over the body of Neo from "The Matrix"
is probably not copyright-clean. The original photo
is copyrighted by whatever the movie company is that
made the Matrix. The modified version may fall under
"fair use", but that's a pretty questionable base for
a Linux distribution.
The image by MC Escher used as a background for the
Heavy GUI desktop is _definitely_ not copyright
clean. See here:

You're right, we have been slacking when it comes to
copyrighted images. The Escher will certainly be removed for
the next release (I falsely presumed his works to be public
domain, as he has been dead for some time now). The matrix
bootscreen, although it was intended as a joke, also should
be removed.
Then again, you can wonder about how far they would go to
inforce their copyrights. Why would it be wrong to have
these on a downloadable CD, and would it be acceptable to
have these on the web? All in all, I personally don't think
it's an issue, although I don't want a lawyer convince me
otherwise...
