The company had filed an action based on breach of an express contract against the buyer for failing to pay for a sign installed on the buyer's property under the agreement.

The company filed a breach of contract action against the buyer for failing to pay for a sign installed on the buyer's property. The buyer alleged that the sign did not comply with the agreement and was not properly installed. But How Can A Minor Become Emancipated? The buyer filed a petition for a writ of certiorari and claimed that the trial court exceeded its jurisdiction by rendering judgment on the value of the sign when the complaint was based on an express contract. The court sustained the trial court's demurrer to the petition and determined that the issues were not limited to those raised in the complaint, but included those raised in the answer. The court found that the buyer's answer enlarged the issues to permit evidence of the reasonable value of the sign if it did not comply with the agreement, but was accepted and retained by the buyer. The court concluded that the superior court had jurisdiction over the matter and that any error would have been an appealable error, not an act in excess of its jurisdiction.

The court sustained the demurrer, dismissed the buyer's petition for a writ of certiorari, and affirmed the trial court's judgment in favor of the sign company.
