The German RegTP regulations allow operation without DFS under the following restrictions: -> indoor operation only -> frequency range limited to 5.15 - 5.25 GHz -> EIRP limited to 60 mW And if you limit your output power to 30 mW, you even get along without TPC...this exception was made to allow a 'hole' for first-generation 11a hardware that could not fulfill the radar detection requirements.
