this was a good lead, i was focused on the appletouch module and 
removing and adding that... what i find weird is that i have a mbp4,1 
and found reload bcm5974 as i don't have a module bcm5973..

seems to work regularly now with dropping a script in sleep.d to 
un/reload the module, i've attached this...
