As far as I know, there isn't any patent on NTFS. If it were then the NTFS
specification would be public but they aren't.
Moreover nobody ever could point out any patent specifically. I asked quite
a lot of people who refered to it. It's a myth what people prefer to believe.
A major Linux vendor fuels the NTFS patent FUD. They only focus on servers and
Linux-only solutions.
Also, only some countries have software patent but it's irrelevant for most
others, at least currently.
