I reckon being open source has always been a condition of entry. The condition applied to entries when they are submitted, so it does not prevent people for developing on their own before submitting. I don't know if it is possible or desirable to push to being open before submitting. In any case, I don't think it's enforcable (if you put code in a public CVS repository, I don't think anybody is going to look at it anyway unless the project is otherwise publicised and organised). Also I think it's relatively rare to get overlapping entries. Well, last year they got three entries of fractals but that's very much the exception.
