Is the "global max upload rate" related to the "run chocker every" setting?

I only ask because it appears the global max upload rate is loosely enforced. It would be great for those of us with more powerful systems could choose the rate at which max speed was checked to force a more strict rate cap.

  No its not related. I realize the cap is a little "loose" as you say. But in my case I currently only see a margin or error within 1-2KB/s. I'm curious what other people are observing.
