If I understand correctly, the reason that free/libre face tracking implementations currently can't use the TrackIR camera is because, in order to enable negotiations between the camera and the software, a haiku must be sent from the software and that haiku is allegedly copyrighted.

Regardless of the absurdity and legality of that concept, the facektracknoir project is only liable if it distributes the haiku, right? Shouldn't it then be possible to make the TrackIR hardware work with facetracknoir if the software doesn't ship with the haiku and the users provide the haiku instead?

      That's an awesome description :-)

I'm going to start calling all closed firmware blobs haiku's from now on:

      Q) Does <some hardware=""> work with Linux?
      A) Only if you have the right haiku for it.

In either case, would it not be possible to support the TrackIR camera under the condition that the user provides whatever data facetracknoir needs and does not hold the copyright for?

It's indeed possible. Just write code required for it to work. You can treat the code as "data ftnoir needs and doesn't hold copyright for".
