I experienced some trouble too when including eXist's output into an XSP.
The XML declaration is mainly needed to get different character encodings
handled correctly by the parser. I will try to add an extra parameter
(omitXMLDeclaration) to all XML-RPC methods which do return an XML
declaration to make this configurable.
