No. encode2mpeg can use the unpatched version of mplayer, dvdauthor, mjpegtools
etc., but you could experience bugs or have some problems with the output.

For every patch included with the encode2mpeg tarball there is, in the README,
an explanation why you should apply it.
If you think the problem that a particular patch solves does not affect you, 
then you do not need to apply the patch(es).
