Using the html stylesheets, an empty <index/> creates a
link in the TOC , even though the generate.index
parameter is 0. I found that the following patch to
autotoc.xsl fixes this:

*** c:/tmp/autotoc.xsl~ Mon May 26 17:50:11 2003
--- c:/tmp/autotoc.xsl Mon May 26 17:50:11 2003
***************
*** 395,401 ****
<xsl:param name="toc-context" select="."/>

<!-- If the index tag is empty, don't point at it
from the TOC -->
! <xsl:if test="* or $generate.index">
<xsl:call-template name="subtoc">
<xsl:with-param name="toc-context"
select="$toc-context"/>
</xsl:call-template>
--- 395,401 ----
<xsl:param name="toc-context" select="."/>

<!-- If the index tag is empty, don't point at it
from the TOC -->
! <xsl:if test="* or $generate.index != 0">
<xsl:call-template name="subtoc">
<xsl:with-param name="toc-context"
select="$toc-context"/>
</xsl:call-template>
