It would come in handy to ping an ip a number of times
before giving it out. Would this be possible un the
near feature?

    It does, as clients ping the server again and again. Server
    inturn forwards the message again and again.

    May I ask why he doesn't do this at my place, for example:
    when I reboot the server he often gives out an ip that is
    already in use, theirfore giving loads off problems for the
    person who had the ip before. Thats what I'm trying to solve

    Normally clients, after getting IP, broadcast ARP message to check for existing of duplicate IP and if they find one, send DECLINE message back to server. This server if gets a DECLINE message from client, immidiately locks the IP address in question and does not alot it again to anyone. Is this not happening ?

    Why server does not do it because it has to wait for full 5 seconds to wait for ARP reply and in the mean time client looking for IP may timeout or aquire the IP from some other server, which may make this server practically non functional.
