The answer is simple - the license is per-developer license per year. If there was no 3.1 nothing would prevent you from doing development with LGPL version and than buy a one license for distribution. Similar restriction exists in Qt license. So it is either LGPL or commercial - you can always switch to LGPL but not the other way around. If you still have problems with 3.1 contact me directly.
