Try without the tilde? I'll be embarrassed if it doesn't handle that, 
but it wouldn't be the first time...

can you send any output to the console 
(/applications/utilities/console.app) from when you try to publish?

I'm very confused about the #2, though- does it quit OK or does it 
crash? and does this really happen all the time?
