5 GPL problem with firmware as it stands at present! - ID: 981219

You release the firmware for the qla2xxx cards as a c
source file containing a string of hex digits and a
copyright notice indicating that it is released under
the GPL.

Section 3 of the GPL says:
"3. You may copy and distribute the Program (or a work
based on it, under Section 2) in object code or
executable form under the terms of Sections 1 and 2
above provided that you also do one of the following:
* a) Accompany it with the complete corresponding
machine-readable source code, which must be distributed
under the terms of Sections 1 and 2 above on a medium
customarily used for software interchange;[...]
[...]
The source code for a work means the preferred form of
the work for making modifications to it. [...] "

This means that you lisence me to redistribute the
firmware files but only if I (offer to) redistribute
the "preferred form" of the source code for making
modifications to it.
Which on the face of it you have not given to me. This
is fine for the copyright holder (ie you) but it does
mean that your license to me to redistribute is kind of
moot.

Please explain to me why I am wrong!?!
