It's always easier to tell people what they're doing wrong if they can tell you exactly what they are doing...
I generated a test case showing what I think is a problem with the saxon:evaluate() function.
A general point though: the right place for XSLT coding help is the xsl-list at mulberrytech.com. You should only really be raising things on this list if there's something about it that's Saxon-specific, and so far you haven't provided any evidence of that.
You're right.  This thread went off topic, but hopefully in a way that helps track down a Saxon problem.
