It isn't, if, and only if, those header's are truly public domain.

The OP was asking about using Microsoft headers.  These are governed
by a Microsoft EULA, which you implicitly accept when you install any
of their products.  You should *read* that, when you install any of
their compiler suites, or development tool kits; I think you will
find that it prohibits such use.  (Usual IANAL caveat applies).
