I followed your recommendation.
I uninstalled fail2ban and removed EPEL repository and installed through rpmforge and it is now working

I've had bad luck with EPEL in the past. rpmforge has a fail2ban rpm, may want to give that a shot. I think I got mine (v0.8.4) from atrpms or atomic some time ago (and have been too lazy to update).
