not that i can help up coding,
but i think i've a point :-)
see if the hal is loaded by firmware loader
your driver (except the hal binary)
could be integrated in distribution kernels and may be in
mainline too, which would make it really easy for newbies
to setup their card. they'll need only to download the hal binary
and put it in the appropriate place, probably they wont need to
do it on every kernel update, or for different kernels.
distribution wont need to ship packages for every kernel,
just the kernels which include the GPL drivers + one hal binary
when for comercial distros, or users of free distros will need
only to download the binary from some place
