The laptop has no other com ports, but that being said you may be
correct how do I go about changing it to com3 is it a case of
Setserial /dev/ttyS2 uart none
modprobe lirc_sir io=0x3e8 irq=4
or is there a conf file I need to change to make it permanent

I have seen no laptop where the IrDA port is on COM1. Usually it is on
COM3. So please check the BIOS settings first and try the other
settings.
The only relevant tool is mode2. Nothing else will work until mode2
generates some output.
