The Basics

Ok, here are the basic rules:

  1. There are two phases: nomination and voting.
  2. The 10 qualified (i.e., for Best New Project the project needs to be new) projects in each category with the most nominations become finalists.
  3. You can’t nominate the same project for the same category more than once.
  4. You can’t vote more than once in each category.

PLEASE READ THESE RULES CAREFULLY. BY SUBMITTING A NOMINATION OR VOTE FOR THE COMMUNITY CHOICE AWARDS, YOU AGREE TO ABIDE BY THESE RULES. THIS IS A LEGALLY BINDING CONTRACT BETWEEN YOU AND SOURCEFORGE, INC. (“SOURCEFORGE”)

Objective:
The SourceForge.net Community Choice Awards (“Awards”) are to recognize projects and their authors who have excelled in the software categories (“Categories”) shown at http://sourceforge.net/community/cca09-categories.

Eligibility:
NO PURCHASE NECESSARY. To be eligible to nominate the winners for the Awards, you must be eighteen (18) years of age or older. Eligibility may be verified at any time.

Employees of SourceForge and any of SourceForge’s subsidiaries, affiliates, advertising and promotional agencies, and members of any such employee’s immediate families or households, are not eligible to participate in the Awards. VOID WHERE PROHIBITED.

The Prize:
SourceForge is not obligated to compensate the winners in any way.

The winners will be announced on SourceForge.net on or around July 23, 2009.

SourceForge reserves the right to publish the project names.

Any project authors who attempt to defraud or in any way tamper with the Awards process will be disqualified and may be prosecuted to the full extent of the law. If applicable, winners are bound by any limitations set forth in their employers’ policies.

Winners may be required to sign and return an Affidavit of Eligibility and Sufficient Rights, and a Liability/Publicity Release, in forms submitted by SourceForge, Inc.

Project Selection Criteria:
Selection for the Awards will be completed in two phases. The first phase will be to nominate finalists for each of the Categories. Nominations will be accepted at http://sourceforge.net/community/cca09 between May 6, 2009 at 10:00 a.m. PDT and May 29, 2009 at 4:00 PDT. Among the nominees for each of the Categories, the finalists for the Awards will be chosen. Voting for the final winners will commence at http://sourceforge.net/community/cca09 on June 22, 2009 at 10:00 a.m. PDT and end on July 20, 2009 at 4:00 pm PDT.

Nominations:
Multiple nominations for the same project in a particular Category from the same submitter will be discarded. Multiple votes in the same category from the same submitter will be discarded

You agree to indemnify, defend, and hold SourceForge, its subsidiaries and its affiliates harmless from any and all liability (including but not limited to claims, damages, losses or injuries of any kind) arising from or related to Your participation in the Awards, or Your use of the projects. In no event will SourceForge be liable to you for acts or omissions arising out of or related to the Awards, or Your use of the projects.

You agree that SourceForge is not responsible for nominations that are late, delayed, lost, stolen, garbled, misdirected, illegible, mutilated, tampered with, forged, incomplete, damaged or otherwise not in compliance with these Rules (and such nominations will be disqualified). SourceForge is not responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to or alteration of nominations; or any problems or technical malfunctions of any telephone network or lines, computer online systems, servers or providers, computer equipment, computer software, failure of any email or electronic notification to be provided by SourceForge on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof, including any injury or damage to a submitter’s or any other person’s computer and/or its contents related to, or resulting from, participation in the Awards. CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE AWARDS IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SOURCEFORGE RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

All nominations become the property of SourceForge and will not be returned.

Odds:
The odds of winning in any category are dependent upon the total number of eligible nominations received.

General Conditions:
The Awards is governed by and interpreted in accordance with the laws of California, USA. You agree that the state or federal courts located in Santa Clara County, California, USA shall be the exclusive venue for any disputes, claims, or causes of actions arising out of or connected with the Awards. The Awards is subject to all applicable federal, state provincial and local laws and regulations. The Awards is void where prohibited or otherwise restricted under any laws, rules or regulations.

Reservation of Rights:
If, for any reason, it is impossible or impracticable to run the Awards as planned, including infection by computer virus, tampering, bugs, unauthorized intervention, fraud, technical failure, causes beyond SourceForge’s control, or other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Awards, SourceForge reserves the right at its sole discretion, to cancel, terminate, modify and/or suspend the Awards and elect to award the Prize to winners drawn from among the nominations received at the time of cancellation.
